This is a Legally valid and binding obligation to release company from all known and Unknown obligations, and to indemnify company against claims brought against It based upon your use of the scooter. This instrument affects important legal Rights.Release and Waiver of Claims. For valuable consideration, the receipt and sufficiency of which are hereby acknowledged Renter does hereby remise, release, and forever discharge Company, Company’s agents, servants, successors, heirs, executors, administrators and personal representatives, of and from all, and all manner of, actions, causes of action, suits, proceedings, debts, dues,contracts, judgments, damages, claims, and demands whatsoever in law or equity, which Renter ever had, now has, or which Renter’s heirs, executors, administrators or personal representatives hereafter can, shall, or may have for or by reason of any matter, cause, or thing whatsoever arising out of this Agreement; out of the use (misuse, or abuse) of the Scooter; or in any way arising out of the rental relationship between Renter and Company. Indemnification For good and valuable consideration, the receipt and sufficiency of which are hereby acknowledged, Renter hereby expressly agrees to indemnify and hold harmless Company, Company’s agents, servants, successors, heirs, executors, administrators and personal representatives against all suits, actions, claims, demands, or damages that arise out of Renter’s use, misuse or abuse of the Scooter. Terms and Conditions 1 - Assumption of Risk: Renter acknowledges that the activities for which the Scooter is designed include inherent dangers, including the risk of bodily injury and/or death. Renter assumes and accepts all risks associated with the use of the Scooter. The vehicle will come registered under the company name and CTP compulsory insurance policy will be taken out in the business name during the rental period. 2 - Insurance – terms of cover: Comprehensive insurance is provided on your rental vehicle. A basic excess of $950 applies to your policy, per claim . If you are under 25 years of age, an additional age excess of $500 applies. If you are 25 years of age or over and have no more than 2 years driving experience, an age excess of $500 applies. In the event the Renter submits a claim during the rental period, you must also pay an administration fee of $250. 3 - Acceptable Use: Renter agrees and acknowledges that he/she will be the sole operator of the Scooter, and will use the Scooter in a careful, safe and conscientious manner. Renter shall at all times observe and adhere to any rules and guidelines posted by Company, and any applicable laws or regulations including NSW traffic laws. 4 - Prohibited Activities: The Scooter shall not be used for any unlawful purpose. Renter shall not violate any of the following rules and regulations during his/her operation of the Scooter: There is no smoking permitted while using the Scooter. There are no alcoholic beverages permitted while using the Scooter. 5 - Fuel: Renter will only fill up the Scooter tank with RON95 fuel. E10 fuels are not permitted. 6 - Liability: Renter must pay all parking, speeding and traffic infringements and tolls in respect of the Scooter during the Rental Period. The repair of any tyre puncture or respective damages will be the responsibility of the Renter. Any amount payable for the repair of the scooter while in the Renter’s possession is financially the responsibility of the Renter. 7 - Unsafe Use: If at any time Company determines that Renter has engaged in an unsafe or hazardous use of the Scooter, Company may immediately terminate the rental. Upon notification of termination, Renter must return the Scooter to the designated return area immediately. If the rental is terminated for unsafe or hazardous use, Renter will not be refunded his/her security deposit. Company shall determine, in its sole discretion, whether any behaviour or activity is “unsafe or hazardous.” 8 - Condition of Scooter upon Return: The Renter shall return the Scooter to the designated return area clean and in the same condition as it was in when given to Renter, excepting ordinary wear and tear. Renter shall be responsible for any damage caused to the Scooter during the rental period. Company shall retain any portion (or all) of Renter’s security deposit as necessary to cover repairs for such damages. To the extent that damages to the Scooter exceed the amount of the security deposit, Renter shall be billed by Company for the full amount of damages caused by Renter during the rental period, including reasonable lawyer’s fees. A tyre puncture kit will be provided when the scooter is leased. If upon return of the scooter the repair kit has been opened, the Renter will be liable for the full cost of the repair kit $50. 9 - Late Return: If Renter returns the Scooter to the designated return area more than 2 days after the scheduled “Return Date,” Renter shall forfeit his/her security deposit. Renter shall inform the company 2 weeks before returning the Scooter. 10 - Rental period: Please note, all Renters are subject to a minimum rental period. If you collect the scooter from our premises in Kirrawee, you will be required to enter into a 3 weeks minimum rental period. If you choose to have the scooter delivered, you must have the vehicle for no less than 4 weeks. If you do not fulfil these minimum rental periods, your bond will not be returned. 11 - Payment terms: Prior to the return of the scooter, ALL invoices must be up to date. Should the Renter fail to pay all due invoices prior to return of the scooter, the initial bond will NOT BE REFUNDED to the Renter. Should the renter fail to make payment for a total of 21 days, the bike will be collected with no notice and the full amount is to be made payable within 3 days. Renter Declaration and AcknowledgementI acknowledge that the purpose of this Declaration & Acknowledgement is to help ensure my personal safety and the safety of other road users when I am using the vehicle under The Agreement between me and the Owner. Use of The Vehicle includes both personal use or for Delivery Services. I expressly consent to the Owner and affiliated entities collecting this information and acknowledge that its collection is necessary for the Owner to assess my fitness to rent The Vehicle and to help ensure my own health and safety when using The Vehicle. I acknowledge that I am not an employee of the Owner and that the collection of this information does not deem the Owner to be my employer or agent when using The Vehicle. I hereby declare: declaration 1* I have a good level of physical health, so I am capable of riding The Vehicle for personal use and/or Delivery services; declaration 2* I do not suffer from colour-blindness, other vision impairment, balance impairment, epilepsy, cardio-respiratory or any other physical or mental condition which could adversely affect my ability to safely control the vehicle. declaration 2* I am able to ride the scooter in variable traffic and weather conditions. I acknowledge and agree that in using The Scooter:declaration 4* I Will wear an Australian Standard- compliant helmet at all times whilst riding the vehicle (unless I hold a valid exemption under local law) declaration 5* Confirm that The Vehicle is roadworthy (including front and back lights if riding at night) and comply with all requirements applicable to scooter. declaration 6* Will not operate The Vehicle in a negligent manner, or in violation of any laws. declaration 7* Renter has read and understands all of the terms, conditions and rules set forth above, and agrees to all terms without reservation.
